Terms and Conditions

The Madrid Adventure Company is a registered Spanish travel agency (Registro de Turismo de Cataluña: GC- 000001538) trading under the name Fiesta Events S.L. and we have certain terms and conditions that you should be aware of because we want you to know what you expect of us and the service we provide and what we expect of you.

We expect you:

  • To behave in a safe and polite manner at all times.

  • To follow the proper instructions of any supervisor or activity leader, either a Madrid Adventure agent or any agent of the supplier for any chosen activity.

  • To dress and equip yourself suitably as indicated by us for any event where special clothing or equipment is to be provided by you.

  • To use safety equipment as instructed and not tamper with or abuse it.

  • To compensate us or our contractors for any damage caused by you in the course of an event.

What makes the events we organize exciting is that they may involve a degree of risk to you of physical injury or damage to property. We do not exclude our liability for death or personal injury caused by our negligence or that our of our employee but we do not accept liability for the negligence of any other persons. We do all we reasonably can to reduce the risk to you. If you have been negligent or have not respected the security instructions, you will take responsibility for the damages which will follow from your negligence.

In order to reduce risk the following conditions will apply:

  • We reserve the right to withdraw you from an event if you do not honour your obligations stated above of these conditions or if, in our opinion, you are not sufficiently fit to participate in any event or if you are under eighteen.

  • You must let us know of any existing medical condition which may affect your ability to participate fully in an event.

  • Furthermore, certain specific activities involve restrictions imposed by our suppliers. E.g weight and height restrictions. We shall endeavour to inform you of these restrictions at the time of booking but the final decision as to the fitness for any event of any individual in a tour party will rest with Madrid Adventure based on the terms and conditions of our supplier and using their advice.

You are not obliged to arrange any accident cover for when you attend an event. However, we think this is important and information is provided on the Barcelona Adventure web site about where to find suitable insurance. We are entitled to assume that either you have arranged your own cover or you are prepared to take the risk of being uninsured.

Occasionally, we or our suppliers may (because of the risky nature of an event) require you to sign a disclaimer releasing us or them from liability for loss suffered in the course of an event. We will not be liable for any loss you may suffer if you fail to sign such disclaimer, whether such loss occurs under this agreement or otherwise.

Invoices and Payment

Madrid Adventure is a Registered Spanish Tourist Agency GC- 000001538 trading under the name of Fiesta Events S.L. and our VAT number is B-64529878. We will provide you with an invoice on confirmation of the event by both parties. We ask every client to provide us with a fiscal address and VAT number (if applicable) which is used only for billing purposes.

In order to secure a booking, we need a pre payment which should be 50% of the total invoice. We, as the Event Management Company often have to pay for many of the service in advance so prepayment is asked for to cover any initial costs.

The second 50% payment is due one week before the date of the first event. Any modifications to the bill will be added onto or taken away from the second payment.

We can accept payments via bank transfer or credit card although a 2% handling fee on all card transactions is applied to all booking made from outside the EU.

Changes in numbers

Madrid Adventure reserves the right to adjust the price should the number of participants quoted in this agreement fall by more than 10%. This is to reflect that there are a number of fixed costs when organizing an event of this nature.

Cancellations

Cancellation costs us money and there needs to be an agreed cancellation policy. We and you agree the following:

Any cancellation must be sent by e-mail by the organizer to the Madrid Adventure email address ([email protected]).Depending on the date of cancellation, you must pay the following cancellation charge:

Date of Cancellation

  • Between 4 and 2 weeks before the event is scheduled to take place:
    50% of the total Package Cost.

  • Less than 2 weeks before the event is scheduled to take place
    100% of the total Package Cost.

If you wish to cancel on behalf of only some members of the group then the cancellation charges outlined above will apply pro rata but we may become entitled to cancel the event (see below), and the group discounts may no longer apply. This may necessitate a further payment by you to pay the difference between the previous discounted price and the revised price. The cancellation shall not be charged if it is due by cause(s) beyond your reasonable control including but not limited to weather conditions that can endanger the safety of the participant, act of god, fire flood, typhoon, earthquake etc.

What if we cancel?

In most cases neither we nor you are entitled to cancel because of adverse weather conditions except if you decide to cancel because the weather can endanger your safety. For some events if the safety risks are, in our discretion or our suppliers´ discretion, unacceptable, we reserve the right to cancel the event. If we do cancel in such circumstances, we will make every effort to reschedule the event for another date. We will not be obliged to give any refund if you cancel an event because of adverse weather conditions. This will also apply to any rescheduled event. However, we will attempt to refund you any fees paid once we have taken account of our reasonable costs and expenses including but not restricted to, any money we have paid to any supplier for the activity, the costs of transport to the activity and reasonable costs for our time and energy.

Unless we cancel in the circumstances described above, we will only cancel if:

  • For reasons beyond our control, we cannot organize the event.

  • You or we become insolvent or in the case of an individual you become subject to a bankruptcy petition.

  • We believe that the booking, any of those associated with it, or the purpose of the booking might damage our reputation.

  • We decide that any reduction in numbers from the original booking makes the event uneconomical or impractical.

Unless we cancel because of safety risks associated with the weather (when we will reschedule) or because of a reduction in numbers (when a cancellation charge may apply), if we cancel we will refund all advance payments made by you and we will not have any further liability to you. We hold all monies pre-paid by you in a separate bank account until the event has taken place or the cancellation policy applies. This is in accordance with the Package Travel Regulations 1992.
